Terms and Conditions

These terms and conditions apply to purchases made on this web site from Borvek Pty Ltd, trading as ABLE WESTCHEM.

1. Orders

1. All orders placed through this web site are subject to confirmation of pricing & quantities, and acceptance by Able Westchem.
2. Able Westchem may vary prices in the event of price changes or mistakes made by suppliers or freighters. If Able Westchem requests payment for increased prices, you may cancel the order by giving notice to Able Westchem, which must be received within seven days of the announcement of the increase.
3. Able Westchem reserves the right to limit or cancel any order placed on our website for the following reasons;
   1. irregular orders are made (i.e. from the same credit card, household or address), or
   2. abnormally large orders are made, or
   3. stock or products or materials become unavailable, or
   4. we are unable to fulfill your order.
4. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
5. Able Westchem will notify you within a reasonable amount of time after your order and will refund you the amount of funds in part of full as applicable.

2. Delivery

1. Dates for delivery are estimates only and subject to the availability of the goods. Able Westchem shall not be liable to the Applicant for any delays in delivery.
2. Able Westchem agrees to make delivery of the goods or arrange transport on behalf of the Applicant at the Applicant’s expense in accordance with the Applicant’s written instructions.
3. Unless otherwise agreed in writing, the mode of transport can be at the discretion of Able Westchem.
4. Able Westchem accepts no responsibility for loss, damage or non-delivery arising by reason of riot, civil commotion, war, whether declared or not, accident, shortened hours of labour, strikes, lock-outs, storm, flood, fire or any other circumstances beyond the direct control of Able Westchem.
5. Able Westchem may deliver such portion of the goods as may be currently available and the Applicant shall accept such portion of the goods. Alternatively Able Westchem may, by notice in writing, extend the time for delivery or cancel all or part of the Contract.

3. Risk and Insurance

1. Risk shall pass to the Applicant, any agent or contractor of the Applicant, whichever is the sooner, immediately on delivery of the goods.
2. The Applicant shall be responsible for insurance of the goods, from the time of delivery, including all risks of loss or damage, to, or deterioration of the goods, from whatever cause.

4. Price & Payment

1. For each online order, you must pay the applicable price for the relevant goods confirmed by Able Westchem.
2. Your order and credit card details are safe and secure. All personal and credit card information provided to Able Westchem is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data.

5. Your Account

1. You agree to take responsibility for the safekeeping of your username and password. You are liable if your username or password is used by an unauthorised person. You agree to release and indemnify Able Westchem in connection with any use (whether authorised or unauthorised) of your user name or password. Able Westchem may suspend or cancel your account at any time without prior notice.

6. Pictures & Images

1. Able Westchem aims to include up-to-date pictures of all of the goods on this website. However, pictures of goods may differ from the actual goods delivered.

7. Privacy

8. Liability

1. Any liability of Able Westchem in connection with goods or services supplied to you is subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Able Westchem be limited to:
   1. in relation to goods, the replacement of the goods or the supply of equivalent goods; and
   2. in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

9. Changes to Terms

1. Each order is governed by the terms and conditions current when the order is placed. Able Westchem may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time your place an order.

10. Applicable Law

1. All purchases under this website and these terms and conditions are subject to the laws of Western Australia, Australia.
